Terms and Conditions – Mr. Mousepad
1. Scope
(1) These Terms and Conditions (T&C) govern the contractual relationship between Mr. Mousepad, represented by MJ Webshops e.K., and customers who order mousepads or similar products with their own design.
(2) All contracts are concluded under German law, regardless of the customer’s location.
(3) Any deviating or conflicting terms and conditions from the customer will not be accepted unless expressly confirmed in writing.
(4) These T&C also apply to future business relationships, even if not expressly agreed again.
2. Contract Formation
(1) The products displayed on our website represent a non-binding invitation to place an order.
(2) Orders are placed via our online forms for sample requests or standard orders.
(3) By submitting the order form, the customer makes a binding offer to conclude a purchase contract.
(4) The contract is established once we send a written order confirmation by e-mail.
3. Prices and Offers
(1) All prices are quoted in Euro (EUR) and exclusive of VAT and customs duties, unless otherwise stated.
(2) Offers are valid for 90 days unless otherwise specified.
(3) Design adjustments, sample production or custom requests may result in additional costs.
(4) Prices are subject to change if the order details are modified.
(5) All shipments to the United States are considered international deliveries. Import duties, customs fees, and taxes are the responsibility of the customer (Importer of Record).
4. Order and Data Storage
(1) Order-related data will be stored and processed in accordance with German and EU data protection regulations (GDPR).
(2) The current version of these Terms can always be accessed and downloaded from our website.
5. Production and Delivery Times
(1) Production begins on the next business day after receiving complete and print-ready artwork.
(2) Typical delivery times are:
– 1–3 business days within Germany,
– 7–14 business days to the United States (depending on customs clearance).
(3) Delivery times are estimates only and may vary due to shipping conditions or customs procedures.
(4) Delays caused by force majeure, strikes, transport issues or governmental actions do not constitute grounds for cancellation.
6. Transfer of Ownership
Goods remain the property of Mr. Mousepad / MJ Webshops e.K. until full payment has been received.
7. Payment Terms
(1) The standard payment method is prepayment (bank transfer or credit card prior to production).
(2) Production and dispatch take place only after receipt of payment.
(3) Invoices are issued in Euro (EUR).
(4) In the event of delayed payment, statutory default interest under § 288 of the German Civil Code (BGB) applies.
8. Warranty and Liability
(1) Warranty claims are governed by German Civil Law (BGB).
(2) For business customers (B2B), the warranty period is one year from the date of delivery.
(3) For consumers, the statutory warranty period applies.
(4) Mr. Mousepad is not liable for import delays, customs handling times, or taxes levied by U.S. authorities.
(5) Mr. Mousepad shall not be liable for indirect damages, lost profits, or consequential damages unless caused by intent or gross negligence.
9. Copyright, Data, and Responsibility
(1) Copyright and Usage Rights:
Mr. Mousepad retains all copyright and intellectual property rights to the produced items or components thereof.
The customer receives only a non-exclusive right of use for the intended purpose.
Production files (e.g., artwork, layouts, templates) remain our property.
(2) Uploaded Files:
Mr. Mousepad does not verify whether the customer holds the necessary rights to reproduce or use the uploaded designs.
The customer guarantees that all files and motifs provided are legally usable.
(3) Indemnification:
The customer agrees to indemnify and hold Mr. Mousepad harmless against any third-party claims resulting from copyright or trademark violations.
(4) Legal Content:
The customer guarantees that all submitted materials comply with applicable laws.
Illegal content (e.g., pornography, hate speech, or violent imagery) will not be processed.
10. Sample Orders
(1) Samples are available under the following conditions:

One free sample for commercial inquiries of at least 50 mousepads.

No samples with private motifs (family, pets, wallpapers, etc.).

Private individuals may order samples for a flat fee of €9.90 (including shipping).

Each additional sample costs €9.90 (net).

Free samples for companies, institutions, schools or government entities are available after verification.
11. Applicable Law and Jurisdiction
(1) All contracts are governed exclusively by German law, excluding the UN Convention on the International Sale of Goods (CISG).
(2) The place of jurisdiction for all disputes is Karlsruhe, Germany.
(3) U.S. law does not apply.
(4) The customer acts as the Importer of Record and is responsible for all customs duties, taxes, and import formalities.
12. Final Provisions
(1) Amendments or supplements to these Terms must be made in writing.
(2) Should any provision be invalid or unenforceable, the remaining provisions shall remain in force.
(3) In place of the invalid provision, the applicable statutory rule closest to the economic intent shall apply.
